Complainant alleged Asbury Water System would not connect its property to the Asbury system. The Office of the Attorney General intervened in this matter. A conference call was held on April 9, 2026, where all the parties indicated they would work towards a resolution prior to a hearing. On April 29, 2026, the parties indicated by electronic mail that a resolution had been reached. The following day, April 30, 2026, a conference call was held, in which all parties and Commission staff participated. The parties went over the agreement and indicated all issues had been resolved. The parties were directed to file a joint motion to dismiss. A Joint Stipulation of Dismissal was filed on or about May 30, 2026, and was perfected with the Secretary’s Office on June 22, 2026. The Complainant, the Respondent and the Office of the Attorney General all signed on to the joint motion.

(B) - Alabama law (Ala. Code § 37-4-22) allows electric utilities, such as Alabama Power Company (“Alabama Power”), to enter into contracts to provide electric service subject to the Commission's approval, which must be based on a finding that the contract provisions are consistent with the public interest.
A recently enacted law, Act No. 2026-610 (“Act 610”), refines the public-interest standard for Commission approval of contracts for retail electric service between a utility and a large load data center customer. Act 610 states that such a contract is consistent with the public interest where the Commission determines that the contract pricing and contract terms and conditions over the contract term are expected to:
1) Provide for the recovery of the incremental costs of retail electric service to the large load data center customer’s premises from the large load data center customer; and
2) Promote positive benefits to other retail electric customers of the utility. While the criteria in Act 610 are consistent with the Commission's current standards, given the emergence of large data centers, it is appropriate for the Commission to evaluate its contract review procedures.

The Electricity Policy Division performed the regular monthly examination of the books and records of Alabama Power Company and determined the Weighted Return on Average Retail Common Equity was 6.21% for the 12 months ending December 31, 2026.
The Staff’s normal monthly review of the Over and Under Recovery of Alabama Power’s energy costs determined an under-recovery of $10,340,015 for the month.
