("Supreme") and to determine the rates, terms, and conditions of service to be implemented by Supreme. It appears that Supreme, which serves customers in the Gorham's Bluff development near Pisgah, is a private corporation that owns, operates, leases, or controls a plant, property, or facility for the supply, storage, distribution, or furnishing to or for the public of water. Therefore, Supreme appears to be subject to the Commission 's jurisdiction. Despite being notified of this jurisdiction by Commission Staff, Supreme has failed to take the required steps to obtain a certificate or receive approval of service rates. Supreme has also failed to assert any legal exemption to the Commission's regulatory jurisdiction.
