(B) - Petition of Pinnacle Wastewater Systems, LLC ("Pinnacle" or "Petitioner") for approval to increase its tariffed monthly sewer rates. Pinnacle's petition, filed on December 27, 2024, proposed a phased-in increase of residential and vacant lot fees, with the first phase taking effect on March 1, 2025, and the second phase taking effect on March 1, 2026. Phase 1 would increase the monthly residential rate from the current rate of $49.50 to $59.50 and the monthly vacant lot fee from the current rate of $15.50 to $18.00. Phase 2 would further increase the monthly residential rate to $62.33 and the monthly vacant lot fee to $20.00. In the petition, Pinnacle supported its request through a reference to the Consumer Price Index.
On January 14, 2025, the Office of the Attorney General of Alabama ("Attorney General") intervened in the matter. On February 4, 2025, the Commission issued an order suspending the proposed tariff through August 28, 2025, to allow sufficient time for investigation and study of the requested changes.
A hearing was held on July 15, 2025, in which representatives from Pinnacle, the Attorney General, and Commission Staff were present and participated. The Petitioner offered sworn testimony at the hearing and several exhibits. At the hearing, Pinnacle failed to provide evidence to show that its proposed rates were based on the recovery of prudently incurred expenses. Instead, the Petitioner described operations conducted without employees, through a related third-party contractor, with much of the expenses involving work on customer-owned equipment. Pinnacle's operational model raises concerns related to Alabama law, Commission rules, and the setting of fair rates.

The Staff’s normal monthly review of the Over and Under Recovery for Alabama Power’s energy costs determined an under-recovery of $10,953,875 for the month.
