On July 10, 2026, the Office of the Attorney General filed a motion to intervene. A hearing was scheduled for July 29, 2026. Prior to the hearing a settlement was reached. In lieu of a hearing, all parties went on the record to put forward the terms of the settlement, and confirmed their agreement to the terms.
The terms of the settlement are as follows: (1) Coosa Bend agrees to be in full compliance within 60 days and (2) pay $16,000 in fines within 90 days. The parties were made aware that a future hearing would be held in 120 days, if the terms of the settlement were not met.

(M) - J. Paul and Kitty Whitehurst, Complainants v. Alabama Power Company. A formal complaint was filed against Alabama Power Company on or about March 27, 2026. Complainants alleged Alabama Power Company has breached its duty to charge just and reasonable rates and requested that the Commission change the rates the Whitehursts pay to the Company. On or about April 28, 2026, Alabama Power Company filed its Motion to Dismiss, asserting that the allegations fail to demonstrate any violation or potential violation of law or Commission rule.
A hearing on the motion was held on June 15, 2026. At the hearing, the Complainants failed to provide sufficient basis for their claim. Further, the requested relief is not permitted by law.

Case No. 2026-1
(B) - Pursuant to the Certificate of Convenience and Necessity granted in Docket 32382, Alabama Power Company ("Alabama Power") has proposed the Clearview Ranch Project ("Clearview Project" or "Project") for evaluation and approval. The Project consists of a 200 megawatt solar photovoltaic generating facility paired with a 200 megawatt, two-hour duration battery energy storage system ("BESS") to be constructed in Macon and Bullock Counties, Alabama. The Project would be constructed, owned, operated, and maintained by Alabama Power. On July 2, 2026, Alabama Power submitted project information to Commission Staff and the Office of the Attorney General.
As part of this proposal, Alabama Power also requested approval of a project confirmation under the Master Contract for Renewable Subscription Program ("RSP") between Alabama Power and its customer Dotier, LLC (“Dotier”). Dotier has subscribed to 100% of the solar portion of the Project for a 20-year term, and Alabama Power will retire the associated environmental attributes on Dotier's behalf consistent with the subscription. The BESS portion of the Project is not allocated to Dotier under the RSP arrangement.
Commission Staff has reviewed the information provided by Alabama Power, issued data requests, reviewed Alabama Power's responses, and analyzed data supplied by Alabama Power in support of the proposed Project. The Staff's evaluation focused on the Project's eligibility under the Certificate; the expected positive economic benefit to customers; the RSP arrangement and its customer-specific contribution; the reasonableness of Alabama Power's avoided-cost analysis; and the projected system benefits associated with the BESS. Based on that review, Staff is satisfied that the Clearview Project meets the criteria specified in the Certificate and recommends approval.

Division Report on Rate RSE and Rate ECR for Alabama Power Company as of June 30, 2026.
The Electricity Policy Division performed the regular monthly examination of the books and records of Alabama Power Company and determined the Weighted Return on Average Retail Common Equity was 6.28% for the 12 months ending December 31, 2026.
The Staff’s normal monthly review of the Over and Under Recovery for Alabama Power’s energy costs determined an under-recovery of $11,114,375 for the month.
